Regardless of how the death occurred, only specific family members of the deceased are eligible to bring a claim for wrongful death in Mississippi. These surviving family members include:

  • Parents and children
  • Siblings
  • Spouses
  • The personal representative of the estate

Most often, wrongful death claims are filed by the victim’s husband or wife. If the couple has a child/children, then any financial compensation that is awarded will be split equitably between the surviving spouse and child.

In Mississippi, the claimants in a wrongful death case can secure an economic recovery for two distinct kinds of damages. These damages include:

  • Economic damages: These damages are compensatory, meaning they are designed to compensate the victim’s relatives for calculable, quantifiable damages, which can include hospital bills the victim acquired prior to their death, funeral expenses, the cost of a burial or cremation, lost income and other earnings, and personal property damage.
  • Non-economic damages: These damages, while also compensatory, are intended to serve as financial recovery for the family’s intangible losses, which are much more difficult to assign value to. Examples of non-economic damages include the pain and suffering the victims endured prior to their death, mental trauma, and, if there is a surviving spouse, loss of fellowship.

The type and total amount of financial compensation you ultimately receive will vary depending on the exact circumstances of your individual case. The best way to calculate the value of a wrongful death claim is to ask an experienced lawyer from MW Law Firm – Mama Justice.
