The question of liability can get complicated in a rideshare accident because there are multiple parties involved with most crashes. Uber and Lyft each divide their coverage amounts into four distinct levels or periods, which will determine how much compensation you can seek from them. The four insurance coverage periods are:

  • Zero (0): There is no coverage provided through Uber or Lyft in Period 0, which is used when the rideshare driver was not using the rideshare app. A crash in Period 0 will involve the driver’s personally purchased auto insurance policy.
  • One (1): Uber and Lyft both provide some coverage when a rideshare driver is using the app but has not accepted a fare, which is described as Period 1. Bodily injury coverage in Period 1 is $50,000 per person and $100,000 per ride, with another $25,000 for property damage. However, insurance coverage is usually provided in Period 1 if the rideshare driver’s insurance does not apply.
  • Two (2): When an Uber or Lyft driver has accepted a fare and is on the way to pick them up, Period 2 insurance coverage begins. If a crash happens in this stage, then Uber or Lyft can provide up to $1 million in liability coverage.
  • Three (3): Once a rideshare driver picks up a passenger and has them in their car, the insurance coverage shifts to Period 3. Up to $1 million in liability coverage is available in Period 3, as well as additional benefits like uninsured/underinsured motorist (UM/UIM) coverage and contingent comprehensive and collision coverage with varying deductibles.

Although these insurance coverage amounts sound great, it is not always simple to actually benefit from them.
